The short version: Sales Gopher gives you a data-driven read on your territory built from public information. The numbers are estimates to guide your work, not guarantees — always use your own judgment, and never use them for patient-care decisions. Be a good citizen with the data, and know that our liability is limited. The full terms are below.

1. Agreement to these terms

These Terms & Conditions ("Terms") are a legal agreement between you and Joel Gaslin, LLC ("Sales Gopher," "we," "us," or "our"), a Minnesota limited liability company, governing your access to and use of salesgopher.ai and the Sales Gopher application (together, the "Service"). By requesting access, creating an account, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What Sales Gopher does

Sales Gopher helps medical-sales professionals plan and manage their territory by organizing publicly available data — including provider information, aggregate Medicare procedure data, open-payments records, and public market and demographic data — into rankings, one-page profiles, market estimates, and suggested outreach. The Service is a planning and productivity tool for professional use.

3. Estimates, not guarantees

Opportunity scores, market-size and "TAM" figures, grossed-up volume estimates, suggested moves, ROI calculations, and draft outreach are estimates and suggestions generated from public data and modeling assumptions. They are provided for informational purposes to support your own judgment. We do not guarantee that any figure is accurate, complete, or current, or that using the Service will produce any particular sales, revenue, or other result.

The Service does not provide medical, legal, financial, or investment advice, and is not a tool for making patient-care decisions. You are responsible for independently verifying information and for how you use it. Where the Service labels something as an estimate or model output, treat it as such.

4. Provider and public data

Data about healthcare providers and facilities in the Service is drawn from public, professional sources and reflects business information, not patient records. It may contain errors, omissions, or out-of-date entries inherent in the source data. You agree to use this information lawfully and professionally, and not to use the Service to harass, defame, or unlawfully target any individual.

5. Your account

Access is currently invite-only. You agree to provide accurate information, to keep your sign-in access secure, and to be responsible for activity under your account. Your account is for your individual use; do not share access or let others use it on your behalf without our permission. Notify us promptly at joel@salesgopher.ai if you believe your account has been compromised.

6. Acceptable use

You agree not to:

copy, scrape, resell, sublicense, or redistribute the Service or its data except as expressly allowed;
reverse engineer, decompile, or attempt to derive the source code or underlying models, except where such restriction is prohibited by law;
use the Service to violate any law or any third party's rights, or to send spam or unlawful communications;
interfere with, overload, or attempt to gain unauthorized access to the Service or its systems.

7. Content you add

You keep ownership of the notes, tags, and other content you enter ("Your Content"). You grant us a limited license to host, process, and use Your Content to operate and improve the Service. You are responsible for Your Content and confirm you have the right to provide it.

8. Intellectual property

The Service — including its software, design, text, logos, and the Sales Gopher name and mascot — is owned by Joel Gaslin, LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. No other rights are granted.

9. Fees

Some features may be free during testing. If we offer paid plans, the price and billing terms will be clearly disclosed before you subscribe, and paid features are subject to those disclosed terms. Payments, if any, are processed by our payment provider; we do not store your card details.

10. Third-party services

The Service relies on third-party providers (such as hosting, email, database, AI, and payment services) and on public data sources. We are not responsible for the availability, accuracy, or practices of these third parties, and your use of them may be subject to their own terms.

11. Disclaimer of warranties

The Service and all data, estimates, and content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any result or figure will be accurate or reliable.

12. Limitation of liability

To the fullest extent permitted by law, Joel Gaslin, LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, data, or business opportunities, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred U.S. dollars ($100).

13. Indemnification

You agree to indemnify and hold harmless Joel Gaslin, LLC from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms or of any law or third-party right.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, and indemnification) will continue to apply.

15. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Minnesota will have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to venue there.

16. Changes to these terms

We may update these Terms from time to time. When we do, we'll change the "Effective" date above and, for significant changes, take reasonable steps to notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
